Hands Burnt for Cable Burning
||Ashfield District Council is sending a clear warning to people that the illegal activity of cable burning will not be tolerated in the District. This follows the successful prosecution of Mr. Terrence Betts for unlawfully burning cable on Sutton Lawn on 30th October, 2007.
At a hearing on 12th March 2008, Mansfield Magistrates found Terrence Betts of Cross Row, Stanton Hill, guilty of the offence under Section 33 of the Clean Air Act 1993. Mr. Betts was fined £375 along with £150 costs to Ashfield District Council.
The offence came to light after Police Officers were called by a local resident concerned about a fire on Sutton Lawn. Police Officers detained Mr. Betts on suspicion of theft but later passed the investigation over to Ashfield District Council Environmental Protection Officers to follow up on the air pollution offence witnessed.
Mr. Chris Booth, Environmental Health Manager at Ashfield District Council said: “The Council is working hard to improve the quality of air in Ashfield. Smoke from cable burning is not only unlawful but has the potential to pose significant risks to human health and to pollute the local environment.
“In this case Ashfield District Council has worked in partnership with Nottinghamshire Police to gather evidence and putting together a prosecution file. The Council will take a tough line against anyone committing environmental crimes. It is hoped that this successful prosecution will raise awareness of the illegal nature of this activity and encourage residents to report future incidents,” he said.
Mr. Richard Fretwell, Chief Inspector for Ashfield said:
“This is a good example of true partnership working, looking to solve problems, not only through criminal legislation but other Civil Remedies. There is a clear focus that all the relevant agencies can work together effectively to improve our communities.”
Anyone with evidence that may help the Council proceed with legal action against people carrying out this activity along with taking a stance against this form of anti-social behaviour, should contact Ashfield District Council on 01623 450000.
