Fine For Take Away Owner

A fish bar owner in Sutton in Ashfield has been fined a total of £240 for failing to comply with food and hygiene standards.

Mr Ismail Yesiloz, owner of the Marmaris Fish Bar at 13 Outram Street, was issued with a Hygiene Enforcement Notice by Ashfield District Council on 7th July 2009.
The notice was originally issued due to Mr Yesiloz failing to ensure certain food safety management systems were introduced and implemented at the premises.

The Council made numerous attempts to offer assistance to Mr Yesiloz, however, he did not choose to accept the help.

After an all day trial at Mansfield Magistrates on 14th July 2010, the defendant was found guilty and was charged with failing to comply with the issued Hygiene Enforcement Notice.

The court found no evidence at the premises of any systems in place to control food hygiene. This included poor temperature control of cooked food, failure to maintain appropriate cooked food temperatures and failure to comply with legislation in relation to food stored in refrigerators, cleanliness and pest control. The magistrates said that Ashfield District Council had made numerous offers of assistance to help the defendant

He was sentenced to a £125 fine, £100 costs and a £15 victim surcharge.  Unfortunately, the defendant now claims benefits and as a result the court can only sentence proportionate to his means.  The offence is punishable by fine only at the magistrates.

Mr Yesiloz ceased trading at the premises in November 2009.

Councillor Wilmott, Ashfield District Council commented “This prosecution enforces the point that the Council take food safety and hygiene very seriously and will act against any individual or business who is putting the health of the public in danger.”
