Ashfield Property Developer Fined Over Two Thousand Pounds

A property developer has been fined £2,267 after failing to clear up waste in Sutton-in-Ashfield.
Ashfield District Council’s Neighbourhood Enforcement was made aware of a complaint by a member of the public and went to inspect the property on Stoneyford Road which was defaced by large amounts of litter and refuse.

East Midlands Developments Limited were traced as the landowners of the property and a letter was sent requesting that they remove the waste from the property within 14 days.

The Council had a letter on file from East Midlands Development Limited dated November 2008 in reference to the same property stating that they wanted the Council to remove waste from their properties.

Correspondence was sent back to the company informing them of their responsibility to remove waste from this property and giving them notice to remove the rubbish.

A Mr Denis Rye from the company wrote back to the Council refusing to comply and after the relevant period a notice was served.

Mr Rye was taken to court on 10th August 2011 and found guilty of failing to comply with the notice and fined a total of £2,267.55.

Edd de Coverly, Head of Neighbourhood Services said: “Failure to comply with notices to clear waste is a serious offence and this case shows it carries a serious penalty, which ultimately could be up to a £2,500 fine. The Council’s Neighbourhood Enforcement Officers work tirelessly to investigate littering cases and this prosecution recognises the real public health risk that this case created. “
