Ashfield District Council under the Local Authorities (Alcohol Consumption in Designated Public Places) Regulations 2007 proposes to make an order identifying the places detailed in the maps and street schedule’s as Designated Public Places. Link to maps and street schedule’s

The Order will allow a Police Constable or other accredited persons such as Police Community Support Officers (PCSOs) and Community Protection Officers (CPOs), to require a person, in a designated place, not to drink alcohol in that place if they reasonably believe that a person has consumed alcohol or intends to do so, and that Anti Social Behaviour is being committed, or may be committed, as a direct result of the consumption of alcohol.

A Person may be asked to surrender the alcohol and any opened or sealed containers in the person’s possession. Any person who fails without reasonable excuse to comply with a constable’s, or other accredited person’s, request under this provision may commit an offence and be liable to prosecution.

A Designated Public Place Order is not a drinks ban, people may still consume alcohol in a Designated area provided that they are not causing any anti social behaviour.

The Order will have no effect on the consumption of alcohol within premises such as pubs, and clubs that have a licence for the sale or supply of alcohol for consumption on the premises or on privately owned land.
