Scrap metal licences

It is recommended that you read the full provisions of this Act before making a licence application. Copies of the Act can be obtained from any of Her Majesty's Stationery Offices (HMSO). Alternatively, a copy of the Act can be viewed at all council offices. If you require further assistance to understand the requirements of the Act please contact the licensing section.
You would be carrying on a scrap metal business and need to apply to Ashfield District Council for a licence, under the following circumstances:
- Any place is used as a scrap metal store
- Your usual place
of residence is within the Ashfield Council Area
- You do not have a scrap metal store in the Ashfield area or elsewhere, but you occupy a place within the Ashfield area for the purpose of that business.
How do I register?
To register you must complete an application form and return the form to the council offices.

Will Tacit Consent Apply?
Yes. This means that you will be able to act as though your application is granted if you have not heard from Ashfield District Council by the end of the target completion period.

Trade Associations
We will need certain information before you can be registered as a Scrap Metal Dealer:
- Dealers full name
- Dealers address or if
company the address of the registered office
- The address of all premises within the Council area that will
be used as a scrap metal store
If any details change or you stop trading as a scrap metal dealer, you must inform the Council within 28 days.
What happens next?
Once the completed application form has been received with the fee, the Council will process the application. When processing an application, the Council will take into account all the details supplied by the applicant before registration is granted or refused.
Do I need to keep records?
Yes, you do need to keep records of all transactions that are carried out during the course of business. These records can be electronic or in a book form and must include the following:
- When obtaining metal
- Description and weight of metal
- Name and address of the person metal obtained from
- Estimated value of metal
- Date and time metal was obtained
- Value of metal if known at time the entry was made
- The registered number of the vehicle used to deliver the metal
When disposing of metal:
- Description and weight of metal
- Date of dispatch or processing and the process used
- Estimated value of metal
- Name and address of person or firm dispatched to
- All entries must be made at the time of any transaction
Can anyone inspect the books?
A Police Constable may at any reasonable time inspect registered premises, any records kept and any scrap metal kept on those premises.
The Council also has powers of entry to the premises to find out if they are being used as a scrap metal store.
