Processing Your Building Regulation Application

photo of new houses in SuttonThis note is aimed to assist you in the process of making a Building Regulation application to Ashfield District Council. Our mission is to provide a friendly, efficient and helpful service to you.

Submitting An Application

On submission of an application it will be checked to ensure that all the necessary documentation and information has been provided for us to carry out our functions. If your application cannot be registered then you will be informed why and what other information is required to be able to register the application.

When full plans are submitted we will endeavour to check the application for compliance with the Building Regulations within the statutory period which is 5 weeks or 2 months (if you agree) from the date of deposit. However, that is not to say that it will take us that amount of time to commence work on your application. In the case of a Building Notice being submitted an Acceptance will be granted (subject to certain provisions) within 5 working days of deposit.

If after we have checked your "full plans" application for compliance with the Regulations and there are aspects of non-compliance we will always (subject to time limitations) give you an opportunity to amend the plans and resubmit them before we reject the application. There is no additional fee to pay for resubmitting the plans if the work has not changed substantially. If you have employed an agent to act on your behalf any correspondence from us will be sent to the agent.

If after resubmission the plans show compliance with the regulations, Approval will be granted and a certificate issued together with a copy of the approved plan(s). It is these plans that must be used when carrying out the work.

There is not a requirement under the Building Regulations for us to consult with neighbours and inform them of your proposal. However, it may be necessary for us to consult with interested bodies such as The Environment Agency, Severn Trent Water etc. Any information held by us will be in the strictest confidence.

Pre-Application Meetings

We also provide a pre-application service in that you can arrange a meeting with one of our Building Control Officers and discuss your proposals prior to submitting a formal application. We have found in the past that this is useful to our customers in that we can provide impartial advice on various ways of meeting the requirements of the Building Regulations.

If you wish to take advantage of this free service then contact one of our officers or call in at our reception located on the first floor of the Council Offices in Kirkby.

Officers are usually available from 8.30am - 10.15am and 2.00pm - 4.00pm.
