Starting Work And Giving Notices At Certain Stages
||The Regulations require you to give notice to the Local Authority for the following:
- Commencement of work
- Excavations for foundations prior to concreting
- Foundation concrete when placed
- Damp proof courses
- Prior to laying any oversite concrete or concrete for a floor
- Drains when laid
- Drains when backfilled
- Prior to occupation of building
- Completion of work
If you proceed with the work without notifying the Local Authority at the statutory stages shown above you may be asked to undo the work as far as it is necessary to ascertain if the Regulations have complied with.
The above are Statutory Notices which must be given to the Local Authority so they can inspect the work. However, the Building Inspector can request that you inform him at other stages of the work for inspection.
Upon all the statutory inspections being carried out and the work being satisfactory we will provide you with a completion certificate. The certificate is an important document particularly when selling your property.
Regularisation Application
Carrying out work without notifying the Authority is a contravention of the Regulations. In relevant circumstances the Local Authority may take action under Section 36 of the Building Act. In the case of unauthorised work commenced on or after 11th November 1985 the owner may apply to the Local Authority for a Regularisation Certificate. A charge, which is not refundable, must be paid when the application is made.
The information to be included in the application will be plans of the unauthorised work as built and plans showing any additional work needed to ensure compliance with the Regulations which were in force at the time the work was carried out.
On receipt of the application the Local Authority may require the owner to open up work in order to determine if the Regulations have been complied with and if any further work is required to secure compliance.
When satisfied that they have enough information the Local Authority will notify the owner of the work if any which is needed to comply with the Regulations. If this work is completed to their satisfaction they can give a Regularisation Certificate.
The fact that an application has been made for a Regularisation Certificate does not prevent the Local Authority from taking action against the owner for a contravention of the Regulations. (download Regularisation Certificate application form PDF)
